Client Agreement

This page sets out FM Digital's standard terms for website build and hosting projects. It's provided here so you can read through it in your own time. Your specific project — pages, price tier, and timeline — will always be confirmed in writing before any work begins or payment is taken.

1. What FM Digital Builds

FM Digital builds static websites — professionally designed, custom-built sites that display your business information online. Ideal for businesses that need a clean, credible web presence.

A static website does NOT include: online booking or appointment scheduling, e-commerce or in-site payments, a login area or members section, a blog you update yourself, or any feature requiring you to log in and manage content, or multilingual support. If you need any of these, raise it before signing — FM Digital can discuss scoping it separately, or suggest a better-suited provider.

What's included: a custom-built site (3–5 pages, as agreed), design and build using your provided content and branding preferences, a private preview link before going live, and up to 2–3 rounds of revisions before launch.

Alternative — Self-Edit Tier. For clients who need to manage their own frequently-changing content (e.g. property listings, menu items) without going through FM Digital each time. Hosting: this tier uses the same hosting as the standard static site, plus a password-protected admin area FM Digital builds for your editable content. Ask if this fits your needs — pricing and scope differ from the standard static build (see Pricing page).

2. Out-of-Scope Requests

If you request a feature outside the agreed scope after signing, FM Digital will explain it's out of scope, discuss whether it can be delivered as separately quoted work, and get your written agreement before starting it. No out-of-scope work begins without a separate written agreement and, where applicable, an additional deposit.

3. How the Process Works

  1. Initial conversation with FM Digital
  2. FM Digital sends a short questionnaire to understand your business and requirements
  3. FM Digital confirms everything is within scope
  4. You sign the agreement and pay the deposit
  5. Build begins
  6. You receive a preview link and approve the site
  7. Remaining balance is paid
  8. Site goes live

4. Payment

See the Pricing page for current build fees, deposit, hosting costs, and edit pricing. Build fee and annual hosting are paid by bank transfer; monthly hosting is collected by Direct Debit.

5. Review and Changes Before Launch

You'll receive a private preview link before the site is published. You're responsible for checking all details — text, prices, contact information, opening hours, images — before approving it to go live. Up to 2–3 rounds of revisions are included before launch at no extra charge.

If FM Digital doesn't hear back on a preview within 14 days, a reminder is sent; if there's still no response 7 days after that, the site is treated as approved and the remaining balance becomes due.

6. After Launch

FM Digital provides ongoing hosting, domain renewal, and basic maintenance as part of the hosting fee. Up to 2 minor changes per month are included (text, prices, hours, contact details, image swaps). Bigger changes — new pages, new functionality, structural redesign — are quoted separately.

FM Digital cannot guarantee 100% uptime, since hosting depends on third-party services outside its control. For issues caused by FM Digital's own build (bugs, broken pages, code errors), FM Digital commits to responding and resolving within 48 hours of notification.

7. Refunds and Disputes

If you cancel before the build starts, the deposit is kept and nothing else is owed. If you're unhappy during the build, revisions are offered first; if you walk away after that, the deposit is kept. Once you've approved the preview and the site is live, the build fee isn't refundable. Hosting cancelled within the first 3 months is refunded pro-rata, minus domain cost; after 3 months, the annual fee isn't refundable.

8. Intellectual Property & Content

On receipt of full payment, FM Digital assigns you the intellectual property rights in your finished website — its specific design, text layout, and code. This doesn't include FM Digital's own general-purpose code, frameworks, or components that get reused across client projects. FM Digital may display your completed site in its own portfolio unless you ask otherwise in writing. You confirm that any content you provide (text, photos, logos, branding) is either yours or properly licensed, and agree to cover FM Digital for any costs arising from third-party IP claims caused by content you supplied.

9. Liability

FM Digital's liability in any dispute is limited to the amount you've paid in the preceding 12 months. FM Digital accepts no liability for consequential losses (lost business, lost revenue, reputational damage) arising from downtime or errors, including third-party outages outside its control. This limitation doesn't apply to death or personal injury caused by negligence, fraud, or anything else that can't lawfully be excluded — and nothing here limits either party's data protection obligations.

10. Ending the Agreement

FM Digital registers and holds your domain on your behalf for the duration of your agreement. If you want to move to another developer or host, FM Digital will export your site's code files and transfer your domain registration, for a one-off handover fee (see Pricing page), delivered within 5 working days.

11. General Provisions

This agreement is governed by the law of England and Wales. It's the entire agreement between you and FM Digital regarding your website build and hosting — any changes must be agreed in writing. If any part of this agreement is found unenforceable, the rest remains in effect.
